These Terms of Use (the "Terms") form an agreement between you and Deaglo Inc. (also known as Deaglo USA Inc.), a Delaware corporation with offices at 575 Fifth Avenue, New York, NY 10017 ("Deaglo", "we", "us"). They apply to the website at www.deaglo.com, the Deaglo platform at platform.deaglo.com, and Deaglo AI, our agent for Microsoft 365 Copilot and Copilot Cowork (together, the "Services").
By accessing or using any of the Services, you agree to these Terms. If you use the Services on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation, and "you" includes that organisation. If you do not agree, do not use the Services.
Some Services may also be governed by a separate written agreement between your organisation and Deaglo, such as an advisory or subscription agreement. If that agreement conflicts with these Terms, that agreement applies.
The Services provide analytical and advisory tools for foreign exchange and interest rate risk. They include market data views, hedging analysis, option pricing analysis, scenario analysis, reports and, on paid plans, access to a Deaglo risk manager.
Deaglo is not a broker, dealer, bank, futures commission merchant or counterparty to any transaction. The Services do not execute trades, place orders, move money or make payments. You execute any transaction with your own bank, broker or other financial institution, under your agreement with them.
Deaglo Inc. is registered with the Commodity Futures Trading Commission (CFTC) as a Commodity Trading Advisor and is a member of the National Futures Association (NFA ID 0556910). See our Regulatory Disclosure.
You need a Deaglo platform account to use the platform and Deaglo AI. You must give accurate information when you register and keep it up to date.
You are responsible for keeping your sign-in credentials secure and for activity under your account. Tell us at once at team@deaglo.com if you believe your account has been accessed without permission.
If your account belongs to an organisation, that organisation's administrator controls who has access, which data is connected and which plan applies. The administrator may add, change or remove your access.
We may suspend or close an account that breaches these Terms, that we reasonably believe puts the Services, other users or Deaglo at risk, or where the law requires it. Where practical, we will tell you first.
Free plan. The Free plan gives read-only market analysis, including spot rates, forward rates, option pricing and a basic hedge comparison. We may change the features of the Free plan at any time.
Risk Manager plan. Risk Manager costs US$99 a month or US$1,069 a year, plus any applicable taxes. It adds the client portal, analysis of your own entities, cash flows, trades and hedge policy, TARF analysis, volatility analysis, reports and presentations, and access to a Deaglo risk manager.
30-day trial. New accounts receive 30 days of Risk Manager at no charge. If you do not subscribe before the trial ends, your account moves to the Free plan.
Billing and renewal. Paid plans are billed in advance, monthly or annually, and renew automatically at the end of each billing period at the then-current price unless you cancel. We will give you at least 30 days' notice of any price change, and it will apply from your next renewal.
Cancellation. You can cancel at any time in your account settings or by emailing team@deaglo.com. Cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are not refundable unless the law requires otherwise. After cancellation your account returns to the Free plan.
Deaglo AI uses artificial intelligence to generate responses. AI-generated output can be incomplete, out of date or incorrect, and the same question may produce different answers. Check important information before you rely on it.
All prices, rates and figures shown in the Services are indicative, for analysis only, and are not quotes or offers to deal. Market data may be delayed.
Nothing in the Services is investment, legal, tax or accounting advice, or a recommendation or solicitation to enter into any transaction, unless Deaglo has agreed in a separate written agreement to provide advice to you. You are responsible for your own decisions and for any transactions you enter into.
Trading foreign exchange, futures, options, forwards and other derivatives involves substantial risk of loss and is not suitable for every person. Hedging reduces some risks but has costs, and a hedged position can perform worse than an unhedged one. Past performance is not necessarily indicative of future results.
When you use Deaglo AI inside Microsoft 365 Copilot or Copilot Cowork, your use of those Microsoft products is also governed by your agreement with Microsoft and Microsoft's terms and privacy statement. Microsoft processes your prompts and the agent's responses under those terms.
Deaglo is not responsible for Microsoft's services or any other third-party service, including their availability, security or content. Links to third-party websites are for convenience only.
You agree not to:
Deaglo and its licensors own the Services, including software, models, methods, designs, text, data compilations and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for your organisation's internal business purposes under these Terms. No other rights are granted.
You keep ownership of the data you provide ("Client Data"). You grant Deaglo the rights needed to host, process and display Client Data to provide the Services to you.
If you send us feedback or suggestions, we may use them without obligation to you.
We treat Client Data, including your entities, cash flows, trades and hedge policy, as confidential. We use it only to provide and support the Services for you, and we do not disclose it to other clients. We do not sell Client Data or use it to train AI models. We may disclose Client Data where the law or a regulator requires it, or to service providers bound by confidentiality obligations who help us run the Services. Our Privacy Policy explains how we handle personal data.
The Services are provided "as is" and "as available". To the fullest extent permitted by law, Deaglo makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability or non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that market data or AI output will be accurate or complete.
To the fullest extent permitted by law, Deaglo will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of revenue, earnings, data or goodwill, or for trading or hedging losses, arising from or related to the Services, even if advised of the possibility.
To the fullest extent permitted by law, Deaglo's total liability for all claims arising from or related to the Services is limited to the greater of (a) the fees you paid to Deaglo for the Services in the 12 months before the event giving rise to the claim and (b) US$100.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or wilful misconduct.
You will defend and indemnify Deaglo and its officers, employees and agents against third-party claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or Client Data that you did not have the right to provide.
You may stop using the Services at any time. We may suspend or end your access under section 3, or end the Free plan or these Terms with 30 days' notice. Sections 5 and 8 to 16 continue after termination. On request after termination, we will delete or return Client Data as described in our Privacy Policy, subject to records we must keep by law.
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. The state and federal courts located in New York County, New York have exclusive jurisdiction over any dispute arising from or related to these Terms or the Services, and you and Deaglo consent to that jurisdiction.
We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date and, for material changes, notify account holders by email or in the Services at least 30 days before they take effect. If you keep using the Services after changes take effect, you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or a successor. These Terms, with any separate written agreement and our Privacy Policy, are the entire agreement about the Services.
